Terms of Service

1. Acceptance of Terms

By accessing or using the Orbb mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Orbb ("Company," "we," "our," or "us").

2. Description of Service

Orbb is a bookmark management application that allows you to:

  • Save and organize web content, videos, and other online resources
  • Search your bookmarks using natural language AI
  • Access bookmarks across devices
  • Integrate with Instagram DMs for quick bookmarking
  • Enrich content with metadata from third-party services (TMDB, YouTube)
  • Request features, vote on feedback, comment, reply, attach screenshots or screen recordings, and view roadmap/changelog updates inside the App

3. Account Registration

3.1 Account Creation

  • You create an account using Sign in with Apple to use Orbb
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account

3.1a Minimum Age and Minors

  • You must be at least 13 years old to use Orbb. Children under 13 may not use the App.
  • Minors (aged 13–17) use a restricted experience: we disable behavioural/interest profiling, targeted recommendations, the Discover feed, and retention/marketing notifications, and show a parental-consent notice.
  • EEA/UK: where your country sets a higher digital-consent age (up to 16) for consent-based features, a parent or guardian must consent on your behalf.
  • India: under the Digital Personal Data Protection Act, 2023, anyone under 18 is a child; we require verifiable parental consent before processing a child's data and do not direct behavioural advertising at children. See the Privacy Policy.

3.2 Account Termination

  • You may delete your account at any time through the app settings
  • We reserve the right to suspend or terminate accounts that violate these Terms
  • Upon termination, your data will be permanently deleted within 30 days

4. User Content

4.1 Your Bookmarks

  • You retain all rights to the content you bookmark
  • By using Orbb, you grant us a limited license to store and display your bookmarks
  • We may analyze bookmark content to provide search and organization features
  • Bookmarks may be processed through third-party APIs (TMDB, YouTube, Gemini AI)

4.2 Content Restrictions

You agree NOT to use Orbb to save or share content that:

  • Violates any law or regulation
  • Infringes on intellectual property rights
  • Contains malware, viruses, or harmful code
  • Is defamatory, obscene, or offensive
  • Violates the rights of third parties
  • Promotes illegal activities
  • Contains private, confidential, sensitive, intimate, or personal information that you do not have the right to share
  • Contains sexual exploitation, child sexual abuse material, non-consensual intimate imagery, threats, harassment, hateful conduct, or instructions for evading safety controls

4.3 Feedback Board, Comments, Public Attachments and Reports

  • Orbb may provide an in-app feedback board where signed-in users can post requests, vote, comment, reply, view roadmap/changelog updates, and receive in-app feedback notifications.
  • Feedback requests, comments, replies, vote counts, status/changelog information, and any screenshots or screen recordings you attach are public to other signed-in Orbb users unless hidden, removed, or merged by Orbb.
  • Do not upload secrets, access tokens, private conversations, payment details, government IDs, health or financial information, private location details, or media showing another person unless you have permission.
  • You are responsible for the feedback, comments, replies and attachments you submit, including making sure you have the rights and permissions needed to post them.
  • You grant Orbb a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, moderate, adapt, summarize, merge, and use your feedback, comments and attachments to operate the feedback board, improve Orbb, communicate roadmap/changelog updates, and provide support.
  • Feedback and suggestions are not confidential. Orbb may use, build, modify, decline, or ship ideas based on feedback without owing you compensation or credit.
  • You may report requests or comments that violate these Terms. Orbb may review reports and may hide, unhide, remove, merge, label, reply to, restrict, or preserve content and account records for safety, abuse prevention, legal compliance, and audit purposes.
  • Orbb may use automated or on-device checks, including Apple's Sensitive Content Analysis framework where available and enabled, to warn about or restrict media that appears to contain nudity. These checks are imperfect and do not guarantee that every prohibited or sensitive item will be detected.

5. Subscription Plans and Payments

5.1 Free Plan

5.3 Payment Terms

  • All payments are processed through Apple In-App Purchases
  • Prices are in U.S. Dollars and may vary by region
  • Subscriptions automatically renew unless canceled at least 24 hours before the current period ends
  • Your Apple account will be charged within 24 hours prior to the end of the current period
  • No refunds for partial subscription periods

5.4 Price Changes

  • We reserve the right to modify subscription prices with 30 days' notice
  • Price changes will not affect current subscription periods
  • You can cancel your subscription before the price increase takes effect

5.5 Cancellation

  • You can cancel your subscription at any time in iOS Settings → [your Apple ID] → Subscriptions
  • Cancellation takes effect at the end of the current billing period
  • You will retain Premium benefits until the subscription expires
  • No refunds will be issued for the remaining days of a subscription period

5.6 Refunds

  • Refund requests must be submitted to Apple Support
  • We do not have the ability to process refunds directly
  • Apple's refund policy applies

6. Instagram Integration

6.1 @orbb.app

  • You can send direct messages to @orbb.app on Instagram to create bookmarks
  • You must link your Instagram account to use this feature
  • We only access messages sent directly to @orbb.app
  • Instagram's Terms of Service and Privacy Policy apply

6.2 Instagram Account Linking

  • Linking is optional
  • You can unlink your Instagram account at any time in app settings
  • Unlinking will disable DM-based bookmarking but will not delete existing bookmarks

7. Acceptable Use Policy

You agree to use Orbb only for lawful purposes. You agree NOT to:

  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated tools (bots, scrapers) to access the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove or modify any copyright, trademark, or proprietary notices
  • Interfere with or disrupt the App's functionality
  • Use the App to store or distribute spam or malware
  • Violate any applicable laws or regulations
  • Circumvent usage limits (e.g., creating multiple accounts)

8. Intellectual Property

8.1 App Ownership

  • Orbb and all related trademarks, logos, and service marks are owned by the Company
  • The App's design, code, and functionality are protected by copyright and intellectual property laws
  • You are granted a limited, non-exclusive, non-transferable license to use the App

8.2 Feedback

  • If you provide feedback or suggestions, you grant us a perpetual, royalty-free license to use them
  • We are not obligated to implement any feedback

9. Disclaimers

9.1 No Warranty

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Service Availability

  • We do not guarantee uninterrupted or error-free service
  • We may suspend service for maintenance or updates without notice
  • We are not liable for data loss due to service interruptions

9.3 Third-Party Content

  • We do not endorse or take responsibility for bookmarked content
  • Metadata provided by third-party APIs (TMDB, YouTube) may be inaccurate or incomplete

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

Some jurisdictions do not allow limitation of liability, so this may not apply to you.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting updated Terms in the App
  • Updating the "Last Updated" date
  • Sending a push notification (for significant changes)

Your continued use of the App after changes constitutes acceptance of the updated Terms.

12. Termination

12.1 By You

You can delete your account at any time through the app settings.

12.2 By Us

We may terminate or suspend your account immediately, without prior notice, if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Abuse the service or other users
  • Do not pay subscription fees

13. Apple Terms

13.1 Acknowledgement

These Terms are between you and Orbb only, not Apple. Apple is not responsible for the App or its content.

13.2 Maintenance and Support

Orbb is solely responsible for providing maintenance and support for the App. Apple has no obligation to provide support.

13.3 Warranty

Apple is not responsible for any warranty claims. In the event of failure to conform to any warranty, you may notify Apple for a refund, and Apple will have no other warranty obligation.

13.4 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Governing Law & Your Mandatory Rights

14.1 Governing Law

These Terms are governed by the laws of the State of [Your State], United States, without regard to conflict-of-law provisions.

14.2 Mandatory Local-Law Protections

Nothing in these Terms removes or limits any mandatory consumer-protection or data-protection rights you have under the law of your country of residence. If you are a consumer in the European Economic Area or the United Kingdom, you retain the mandatory protections of the law of your country of habitual residence. If you are in India, your rights under the Digital Personal Data Protection Act, 2023 and applicable consumer law are unaffected.

14.3 Privacy & Grievance Mechanism

Our Privacy Policy is incorporated into these Terms by reference and describes how we handle your personal data, your data-protection rights, and our grievance mechanism. Privacy questions: privacy@orbb.app. India grievances (DPDP Act): grievance@orbb.app, with escalation available to the Data Protection Board of India.

15. Creator Rewards Program

15.1 Eligibility

  • You must have an Orbb account in good standing that is at least 14 days old.
  • You must have completed onboarding and saved at least one bookmark.
  • Orbb employees, contractors, and immediate family members are not eligible.

15.2 Submissions

  • You may submit only videos you personally created and published on a public platform.
  • You must include the verification code Orbb provides in the description of your video and keep it there until your submission is approved or rejected.
  • You may submit multiple videos, but only videos that have reached at least 2,000 organic views within 90 days of submission are eligible.
  • You may not buy views, use bots, or otherwise inflate view counts. Doing so will result in immediate rejection and may result in account termination.

15.3 Disclosure

  • You must comply with all applicable laws and platform policies regarding sponsored content, including the U.S. Federal Trade Commission's Endorsement Guides.
  • You must include "#ad" or a clear written disclosure in your video and its description that you may receive compensation from Orbb.

15.4 Approval

  • Submissions are reviewed manually. Approval is at Orbb's sole discretion.
  • We may reject any submission for any reason, including suspected view inflation, content we deem inappropriate or misleading, missing disclosure, or violation of platform terms.
  • Approval decisions are final.

15.5 Rewards

  • Approved submissions earn one Apple App Store promotional offer code redeemable for one (1) free month of Orbb Pro.
  • Rewards are limited to one (1) per user per calendar month, regardless of how many videos qualify in that month.
  • Codes are subject to Apple's terms, must be redeemed in the Apple ID storefront they were issued for, have no cash value, and are non-transferable.
  • Codes expire according to Apple's offer code rules. Orbb is not responsible for unredeemed codes.

15.6 Anti-Abuse

  • Orbb may withhold or cancel rewards, revoke premium status, and terminate accounts that engage in fraud, including botted views, duplicate accounts, false ownership claims, plagiarized content, or any other abuse, without notice.
  • Orbb may share data about suspected abuse with Apple and third parties as needed for fraud prevention.

15.7 Program Changes

  • Orbb may modify or terminate the Creator Rewards Program at any time without notice.
  • Unredeemed approved codes already issued remain valid for the period defined by Apple.

15.8 No Relationship

Participation in the Creator Rewards Program does not create any employment, agency, partnership, or franchise relationship between you and Orbb.
